End-User License Agreement (EULA)

1. Acknowledgement

You and the End-User acknowledge and agree that:

a) This EULA is concluded solely between Kiril Volskyi (“You” or “Licensor”) and the End-User, and not with Apple, and that Kiril Volskyi, not Apple, is fully responsible for the Licensed Application and its content.

b) This EULA must not include usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions as of the Effective Date (which You acknowledge having had the opportunity to review).

2. Scope of License

a) Under this End-User License Agreement (EULA), Kiril Volskyi (“Licensor”) grants the End-User a non-transferable, non-exclusive license to install and use the Licensed Application (“App”) on any Apple-branded device that the End-User owns or controls, and only as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

b) This license does not allow the End-User to use the App on any device they do not own or control, and the App may not be distributed or made available over a network where it could be used by multiple devices simultaneously.

c) The End-User may not rent, lease, lend, sell, redistribute, or sublicense the App. If the End-User transfers ownership of their Apple device to another person, they must remove the App from that device before doing so.

d) The End-User may not copy (except as permitted by this license and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof, except as and only to the extent any such restriction is prohibited by applicable law or allowed by the licensing terms of any open-source components included with the App.

3. Maintenance and Support

a) The Licensor is solely responsible for providing any maintenance and support services for the Licensed Application (“Grammix”), as specified in this EULA or as required under applicable law.

b) Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

c) Any questions, complaints, or requests for support should be directed to the Licensor at the contact information provided in this EULA.

4. Warranty

a) The Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent that such warranties are not effectively disclaimed.

b) In the event of any failure of the Licensed Application (“Grammix”) to conform to any applicable warranty, the End-User may notify Apple, and Apple will refund the purchase price for the App to that End-User.

c) To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty shall be the sole responsibility of the Licensor.

5. Product Claims

a) The Licensor and the End-User acknowledge that the Licensor, not Apple, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application (“Grammix”) or the End-User’s possession and/or use of that App.

6. Intellectual Property Rights

The Licensor and the End-User acknowledge that, in the event of any third-party claim alleging that the Licensed Application (“Grammix”) or the End-User’s possession and use of the App infringes that third party’s intellectual property rights, the Licensor, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. Third-Party Terms of Agreement

The End-User must comply with all applicable third-party terms of agreement when using the Licensed Application (“Grammix”).

The End-User is solely responsible for ensuring that their use of the App does not violate any such third-party agreements or terms.

10. Third-Party Beneficiary

The Licensor and the End-User acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA. Upon the End-User’s acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against the End-User as a third-party beneficiary.

11. In-App Purchases and Subscriptions

a) The Licensed Application (“App”) may offer access to premium content, features, or functionality through in-app purchases or auto-renewable subscriptions.

b) Payment will be charged to the End-User’s Apple ID account at the time of purchase confirmation.

c) Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the current subscription period ends.

d) The End-User’s account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.

e) The End-User can manage or cancel subscriptions and turn off auto-renewal after purchase by going to Settings > Apple ID > Subscriptions.

f) Any unused portion of a free trial period, if offered, will be forfeited when the End-User purchases a subscription.

g) The Licensor does not have access to or control over Apple’s billing system. Refunds and cancellations must be handled through Apple in accordance with their policies.

h) In the unlikely event that a purchased subscription or in-app item fails to activate, renew, or deliver correctly, the End-User should first verify their purchase status through their Apple ID account. If the issue persists, the End-User may contact Apple Support to request a refund, or reach out to the Licensor’s support team for technical assistance.

i) Certain features within the App may allow the End-User to spend in-app currency or credits to generate or unlock digital content. In rare cases, the content generation process may fail even though the in-app currency has been deducted. In such cases, the deducted balance will not be restored or refunded, but the End-User may contact the Licensor’s support team for assistance or clarification regarding the issue.

j) If the End-User chooses to delete their account within the App, they must first cancel all active subscriptions associated with their Apple ID through Settings > Apple ID > Subscriptions. Account deletion within the App does not automatically cancel active subscriptions or stop future charges processed through Apple.

k) Each subscription purchased through the App applies only to the End-User’s internal App account and is not transferable between different App accounts or Apple IDs. Premium content and subscription features are accessible only from the same in-app account used at the time of purchase. Using a different account, even under the same Apple ID, will not grant access to premium features or previously purchased content. Each subscription is permanently bound to the in-app account where it was activated.
